Are There Really Legal Highs?

The title may automatically make you wonder if that means there are legal highs and illegal highs. The answer is yes, there can be.

All "highs" are simply altered states of consciousness. In other words, the brain and body are reacting to chemicals and ingredients found in drugs (both legal and illegal), alcohol, and herbal substances such as K2 Incense, Salvia Divinorum, Kratom, Entheogens or similar substances.

The difference between legal and illegal highs is or can be the very chemicals and ingredients, especially those found in herbal substances. So, basically, to put it succinctly, "legal highs" come from herbs that do not contain controlled substances; "illegal highs" do.

The absence of a controlled substance, however, does not necessarily mean that everything is copasetic, especially when it comes to law enforcement and legal matters. There is the chance that a state or local law enforcement agency or legal community will have decided that there aren’t such things as "legal highs", because it is against the law to possess even those herbal substances that do not contain controlled substances. The only way to determine if this is the case in your location is to research local and state laws, ordinances, and statutes concerning herbal substances that do not contain controlled substances.

Depending on the state and local laws where you live, it may not be illegal to possess, use, grow, or even sale or distribute herbs such as K2 Incense, Salvia Divinorum, Kratom, other Entheogens or similar substances. Again, you will need to check this out. IF they are not considered illegal, then you should not encounter any legal problems. However, this does not mean that you won’t get into legal trouble if you break the law in some other way while on a "legal high".

Here is an example: you are driving while on a "legal high" (something you should not be doing, just like you shouldn’t drink and drive) and cause an accident in which someone is severely injured or even killed. Law enforcement authorities may not be able to charge you with anything pertaining to the product you've used to achieve your altered state; however, you are not exempt from being charged with any traffic (DUI) or other laws you may have broken as a result of causing the accident.

So, if you currently use or are thinking about using K2 Smoke Incense, Salvia Divinorum, Kratom, other Entheogens or other herbal substances that can cause "legal highs", you may want to take the following things into consideration:

  • Getting your "legal highs" private matter and should be done in a private place. You might wish to stay at home or a friend’s house while using K2 incense or other things. In this way, you will not be tempted to drive, and you will not draw undue attention.

  • Not driving or otherwise engaging in activities that can cause danger to you or others until your "legal high" has worn off. Stay where you are until you are completely free of any of the influence the herbal substance you used.

If you are of an age where you can make your own decisions and can be responsible for any consequences that may arise, then enjoy your "legal highs". It is, after all, a personal decision. Choose your surroundings wisely when you get ready to buy k2 or use any product, and make sure that you and others who may come in contact with you will be safe when you are enjoying your "legal high".
