No fault insurance can be quite confusing. It sounds like no one in the accident is responsible or that it does not matter who is responsible. Many believe since they have no fault insurance they do not have to contact their insurance company. Both of these statements are false. All individuals in an auto accident are required to contact their insurance company no matter who was responsible for the damage.
This type of insurance found in Ontario covers every passenger in the cars that were involved in the accident. Every passenger must also contact their insurance company to learn what benefits are available to help with their medical costs. Every accident will be judged and a determination of fault will be declared. In some cases, accidents can be deemed "no fault". In most cases, this is found when road conditions played a part in the accident. The police may decide the road was at fault, while the insurance company will still find someone to blame. The driver at fault must pay a deductible for damages, which can cause insurance premiums to rise when the policy is renewed.
Some people do not agree with the at fault status that their insurance claims. The good news is that there are ways to fight your insurance company such as via your companies Ombudsman Liaison Officer. If this does not help, you can go another step by contacting the Ontario Insurance Ombudsman. Another option is available if you do not receive a fair outcome and that is through the court system.
