Eviction process is a legal process which makes the unlawful owner of the house leaves the property. This usually happens after the bank has taken the property and auctions it through foreclosure. The eviction process takes place when the new owner of the property which usually in this case is the bank issue a legal notice to the former owner of the house to leave the place soon.
The bank does all this through court’s notice and they then wait for a few days for the former owner to leave the place with their belongings. This process may take from two weeks to about four weeks time. The evacuation process is done through the help of the local police or sheriff’s help. They give a formal deadline to the owners to leave the place in the given time period or else they can take serious actions against the owner if they don’t leave the place.
The main problem for eviction arises when the owner is not paying mortgage regularly and the bank starts taking action against such people. The bank does show some leniency towards the people but then has to take action in order to recover their money.
Eviction process varies from state to state in the USA ranging from about ten days and may take up to six months even. There is some leniency shown towards the former owners during the foreclosure and eviction process and the owners should try to get done with the process as quickly as possible in order to avoid any serious consequences.
California is one of the most advanced and popular states in the USA and the laws are strict and the police and legal departments strive hard to counter any problems. If you have mortgaged your property in California and are now unable to pay the rest of the mortgage then it is advisable for you to pay mortgage regularly or face hurdles from bank and the law enforcement departments.
You can also ask for some extra time from the bank and if they allow you extra time to repay the mortgage then you still have that time period to stay on the property and no one will force you to leave the place before the given time period. You might face the redemption period before the eviction process takes place.
It is advisable that you should not indulge yourself in serious legal matters and if there is no way you can find to pay off the mortgage then you should leave the place and find a new place to settle in. the bank takes over the property and they then auction the property in the market so that new owners can come and pay off the amount.
The bank usually send the local police or the sheriff with the court orders to remove the defaulted owners from the property so that any mishap happens the law enforcement department is present to counter any problems made by owners during the eviction process.
