There has been a significant rise in employee criminal background checks over the past five years and negligent hiring lawsuits are becoming more and more common . These lawsuits can be devastating to a company and are something every company should be aware of and prepared for. If you're in
the position of a hiring manager or a decision maker within a company, it's important to know the facts. Your organization can be legally liable for negligent hiring if you fail to do your due diligence and conduct a solid pre employment background check for all of your applicants. You can also be sued for negligent hiring if your company doesn't take the proper steps to ensure that a potential employee has the proper suitability or ability to work at certain positions. You can be sued if you do become aware of a problem but do not take corrective action to fix the problem. Negligent hiring lawsuits can cost a company millions of dollars, and as an employee who is responsible for hiring, they can also cost you your job. By not conducting a proper pre employment screening your company is at serious risk
of dealing with negligent hiring lawsuits.
There are numerous ways to perform an employee background check. The most common employee criminal check is the onsite county criminal check. An onsite county criminal check is performed by hiring a court researcher to perform a search of a known county that the new employee has previously
lived in or has lived in the past.
A comprehensive employment background check package can include a driver vehicle records, county criminal search, statewide and national criminal search, drug testing, degree and employment history verification as well as other verification options.
